back in broad daylight. He stumbled across the street to a 7-11 store and collapsed on the floor. APD
Officer Ronald Merriman … was dispatched to the scene, as was the Fire Department. The medics later
testified that Officer Merriman refused to allow them to treat Curtis until he finished interrogating him.
Curtis bled to death at the scene. Curtis was schizophrenic and used marijuana as a type of self-
medication. His father, Victor Lindsey, says APD shrugged off the murder as “just one drug addict killing

2017/12/27 Court Sides with New Mexico officer in minivan shooting
Excerpt from US -2017/12/27-by Susan Montoya Bryan: A federal appeals court ruled Wednesday that a New
Mexico police officer did not violate the constitutional rights of a woman and her five children when he
shot at their minivan as they fled a chaotic traffic stop in 2013.
The 10th Circuit Court of Appeals issued the ruling in the case filed by Oriana Farrell, who was pulled over
for speeding and led officers on a high-speed pursuit through the tourist enclave of Taos.The appeals court
found that the case against Elias Montoya, the officer who fired three times at the van and later left the
force, should have been dismissed by a lower court.Montoya's defense rested on the principal of qualified
immunity, which shields public officials from legal actions unless their conduct was unreasonable in light of
clearly established law.

was indicted on 18 counts of criminal sexual contact with a 5-yr-old child. (Montoya was the

former police officer Pete A. Montoya of 18 counts of criminal sexual contact with his former
stepdaughter."It's been a long two and a half years," Montoya said, wiping tears away after the
jury delivered its verdict. "Thank the Lord, it's finally over."Montoya, 51, was accused of touching
the girl, now 14, exposing himself to her and coercing her to touch him sexually. He was also
accused of intimidating a witness and of contributing to the delinquency of a minor.

Excerpt from Abq Jrnl-2009/04/21:The New Mexico Law Enforcement Academy suspended Montoya in March after
hearing evidence of allegations that Montoya improperly used a police gas card for personal purposes while he was
a patrol officer in Las Vegas, The Range said. Meanwhile, Montoya faces felony criminal charges in Las Vegas in
connection with the gas purchases as well as for allegedly submitting time sheets that claimed he was at work for
the police department when he was not, the paper reported. Twenty counts — 19 for forgery and one for fraud —
were filed in Las Vegas Magistrate Court after a State Police investigation, and Montoya is -cheduled to be arraigned
on April 28, The Range said

Munoz David Albuquerque, APD - joined in 2012. Officer in 2013 at time of Sherrill shooting. Other officers involved in Sherrill
shooting were Luke McPeek and Jim EdisonMcPeek was there first, Munoz and Edison came later and also fired at Sherrill.
Sherrill had been suicidal before the incident. He was waving either a brake pad or folding knife, or both, at the time of the
shooting, Victim Shaine Sherrill who in 2013 was non-fatally shot by officers, ABQ Jrnl

Sherrill did not comply with the officer’s commands, Banks said, and that’s when McPeek fired at him. By
then, officers David Muñoz, who joined APD in April 2012, and Jim Edison, who joined in 2007, also had
arrived at the scene. They also fired at Sherrill.
