Damon Fay is a 24 year veteran investigator and supervisor for the Albuquerque Police Department in New
Mexico. He was a primary case agent for homicides, police officer involved shootings and major violent
crimes cases for 14 of his career years. As a supervisor he led an officer involved shooting team and assisted
in numerous major crime joint jurisdictional investigations and task force initiatives. Damon is a recognized
expert in homicide investigations, police use of force and pattern injury identification. During his extensive
investigative career he has developed nationally accepted procedures for cold case homicide investigation
and has become one of the leading circumstantial case specialists in the country. He has been called upon
numerous times in his career to provide expertise in complex, high profile and highly sensitive investigations
by local, state and federal prosecutors and Police Command Staffs. As a Sergeant of the Advanced Training
Unit of the Albuquerque Police Academy, Damon and his staff oversaw the specialization training and career
advancement of police personnel. He is an instructor in Firearms, Defensive Tactics and ground fighting, Use
of force and intermediate Use of force, Homicide and cold Case Investigation, Major Case Management,
Interview and interrogations and Contact Weapons Defense. Sgt Fay holds a 3rd degree (3rd Don) black belt
in Tae Kwon Do through the United States TKD Federation and the International TKD Federation, and he is a
Kali/Eskrima student. He lectures and teaches through out the United States and is the co-author of Contact
Weapons: Lethality and Defense published by Gun Site Press.

Excerpt from Real Crimes: Katherine Teupell was awarded a $235,000 settlement for claims against the Bernalillo
County Sheriff's Department and the Albuquerque Police Department for their use of a “We don’t do blue” policy in
dealing with an officer accused of beating his wife. Teupell alleged police extended “professional courtesy” to her
husband, Scott Finley, a member of the Sheriff Department’s elite Crime Suppression Unit. Teupell testified she fled
from her home with her children, 6 and 2, still in pajamas, on the night of Oct. 18, 1993, after Finley beat her. Teupell
said that when she threatened to call police, Finley responded, “Go ahead and call. How can you break the law
when you are the law?" Although the APD officer who responded to the call confiscated Finley's police revolver,
other officers who took over at the scene returned it.

officer involved in a deadly shooting earlier this month came back with no lapel video. It was his second officer-
involved shooting, and the second time he came back with no video….
Officers Michael Oates and Matthew Fisher were involved in the shooting along San Mateo Boulevard this month,
and Fisher’s lapel video is the only one available from the incident
APD said it can’t answer whether Oates will be disciplined for the 2015 shooting because of a personnel issue and
the department has to wait until the criminal investigation is complete before the administrative one can begin.
The administrative investigation must be completed before Chief Gorden Eden can decide whether to discipline
Oates. The city’s policy requires officers to turn their cameras on when they interact with the public. If they don’t,
it’s up to the chief to decide what disciplinary action will be taken. Eden is in Washington, D.C., for a conference,
and unavailable for comment.

alleging the deprivation of civil rights led to the death….Afterward, the city nuisance abatement unit gave the
family 30 days to repair the extensive damage done to their home during the standoff and shootout, the
Journal reported in 2012. The damage to the home is not part of the civil rights lawsuit….According to the
lawsuit filed on behalf of Chavez’s mother, Rachel Hernandez, SWAT officer Drew Bader was captured on
lapel videos from the incident laughing at and mocking Chavez before Chavez shot himself, and a New

Both officers were working as Valley Field Patrol Officers on the night of the shooting. They were both
hired in October 2009…Albuquerque police identified the two officers involved in last Thursday's fatal
shooting Ryan Graves and Brian Fuchs…Police said Graves and Fuchs shot and killed Ralph Chavez last
Thursday night after they said he got into a fight with a woman and slashed the throat of a good
Samaritan who tried to come to her aid. The good Samaritan is in stable condition and recovering,
according to the Albuquerque Police Department. Chavez approached the officers saying "Shoot me,
Shoot me," according to audio released Friday by police. There is lapel video of the incident, but it
hasn't been released.
