COMMENTS
*From Vox: On insert below on Democrats fighting big companies like Amazon, etc. all this is fine and good, but given
what we know about Democrat tendencies in other areas, including lawsuit slush funds and sending large amounts of
dollars from large companies as “donations” to “social justice” platforms run by Democrats, we have to ask if something
else is going. One possibility is an ongoing tendency to weaken an adversary through a process referred to as “softening”
on this website - a planned and habitual form of destabilization - only to turn around and put in their own players who
quickly take over the operation and turn it into their own type of totalitarian system. Democrats have those in their ranks
who repeatedly display anticompetitive tendencies, in other words.
We can still learn from the language and ideation of antitrust and anticompetition materials, as bits and pieces start to
trickle in about what is actually going on and who the main players are. Whether Democrat, Republican, Libertarian or
something else, sources for our growing information bank should be widespread and fluid.
We can learn from old fights against monopolies in American history, and must start there. Then we likely should build on
that to try to see how current anticompetitive operations look and feel like that old thing while coming to terms with what
is different. In this process, we also likely will realize parts of the old monopoly break-ups apply, but given
internationality* and multiplicity*, addended and modernized responses will likely be required.
*When company factories and administrative offices span nations, we can be dealing with different sets of laws and
cultural approaches.
*It’s not just the main company we usually see, but all the companies that provide the parts, for example. We can ask: do
together these inter-related companies operate as a monopoly in the market?

Excerpt: Note this is a private law firm. n January 17th, the Federal Trade Commission (FTC) filed an antitrust lawsuit
against Qualcomm (QCOM), the lead supplier of chips used by our mobile phones. The company has been accused of
conducting a monopoly in the market via their patent-licensing terms with phone partners.; specifically, of strong-arming
Apple into using its product in iPhones by lowering the associated patent-licensing fees.

NOTICE TO POTENTIAL CLASS MEMBERS: If You Have Purchased A Cellular Phone Since February 11, 2011,
A Class Action Lawsuit May Affect Your Rights.
https //www mobilephoneclassaction com/
Excerpt: A lawsuit is pending in the United States District Court for the Northern District of California (the
“District Court”) against Qualcomm Incorporated (“Qualcomm”). Plaintiffs in the lawsuit claim that
Qualcomm violated state and federal antitrust laws in the United States, harming competition and causing
consumers to overpay for cellular phones. The case in the District Court is currently stayed pending an
Appeal to the Ninth Circuit on the decision to certify a class. The lawsuit is about whether Qualcomm
engaged in anticompetitive conduct that raised the price consumers paid for cellular phones. The cellular
phones involved in this litigation include phones with CDMA and LTE technologies. This includes cellular
phones manufactured and sold by companies such as Apple, Samsung, LG, Motorola, and ZTE. A list of all
models of cellular phones included in this litigation is available here. On September 27, 2018, the District
Court determined that this case could proceed as a class action. Qualcomm appealed the District Court’s
decision to certify this case to the Ninth Circuit. The Ninth Circuit heard oral argument on Qualcomm’s
appeal on December 2, 2019, and the Ninth Circuit has not yet issued a ruling on the appeal. The District
Court case is stayed pending the Ninth Circuit appeal.

Four Main Anticompetitive Companies: One Report
Vox dot com
2020/10/06 The Big Tech antitrust report has one big conclusion: Amazon, Apple, Facebook, and Google are anti-
competitive: The report scrutinizes the ways the four biggest tech companies have amassed enormous market power. By
Shirin Ghaffary and Jason Del Rey
https //www vox com/recode/2020/10/6/21505027/congress-big-tech-antitrust-report-facebook-google-amazon-apple-
mark-zuckerberg-jeff-bezos-tim-cook
Excerpt: A long-awaited report from top Democratic (*See Comments) congressional lawmakers about the dominance of
the four biggest tech giants had a clear message on Tuesday: Amazon, Apple, Facebook, and Google engage in a range of
anti-competitive behavior, and US antitrust laws need an overhaul to allow for more competition in the US internet
economy. “To put it simply, companies that once were scrappy, underdog startups that challenged the status quo have
become the kinds of monopolies we last saw in the era of oil barons and railroad tycoons,” the report’s introduction
states. The 400-plus page report, written by the majority staff of the Democratic members of the House Judiciary
Subcommittee on Antitrust, is the result of a 16-month investigation into whether these corporate giants abuse their
power, and whether the country’s antitrust laws need to be reworked to rein them in. The report released Tuesday cites
numerous examples of each tech titan engaging in acts that the lawmakers believe have hurt innovation and impede
competition. While the anti-competitive behaviors cited vary from company to company, they are all linked by the
allegation that the four giants abuse their gatekeeper status in various internet industries to secure and grow their
market power in those sectors and others. So what’s the solution? The report recommends creating new laws that would
potentially break up tech companies and make it harder for them to pursue acquisitions; it also calls for clarifying existing
antitrust laws with the goal of making them easier to enforce, particularly for tech companies. For now, the report’s
recommendations are only high-level guidance to Congress for potential future legislation; it won’t lead to immediate
action against these companies.
